All reservations, whether made by phone, email, or mail, imply acceptance of our terms and conditions.

We reject all total or partial liability in cases of fault or actions by the customer, as well as all unforeseeable, irresistible, or force majeure circumstances such as:
traffic disruptions, congestion, demonstrations, roadworks, breakdowns;
accidents;
strikes;
demonstrations;
weather conditions and bad weather;
malfunctions of telecommunication networks, shortage of labour or equipment;
flight or baggage delays, and technical failures of the vehicle.

Any compensation not fully attributable to the company will be limited to the coverage of our insurance.
It is essential to inform us if large luggage must be loaded so that an appropriate vehicle can be provided.


GENERAL TERMS AND CONDITIONS OF SALE – RMB TRANSPORTS

(Version of November 10, 2025)

Michel BERNARD Services, operating under the trade name RMB TRANSPORTS, provides paid transport services using chauffeur-driven vehicles with fewer than 9 seats, exclusively by reservation, at a pre-defined price, as well as school transport services for disabled pupils and students.

Its activity has been authorised:

  • by the Ministry of Transport through the issuance of licence no. 2022/32/0001219 “Public Road Passenger Transport” (LOI LOTI).

  • by the Prefect of Pas-de-Calais, VPR operating authorization no. 62-0402.

  • by the Ministry of Transport, registration in the register of operators of chauffeur-driven transport vehicles no. EVTC062140003.

Michel BERNARD also holds the professional taxi driver card no. 120856 for the Pas-de-Calais department. The registered office of Michel BERNARD Services is located at 7 bis rue du 19 Mars, Thélus (62580).
The company is registered in the Arras Trade Register under no. 514 539 444 RM59, and with the Commercial Court Registry under no. 514 539 444 RCS Arras.


1. PURPOSE

These General Terms and Conditions define the conditions applicable to transport service contracts concluded between RMB TRANSPORTS and its clients. By using RMB TRANSPORTS services, the client is deemed to have read and fully accepted these General Terms and Conditions of Sale.


2. FORMATION OF THE TRANSPORT SERVICE CONTRACT

2.1. Submission of a service request by the client

The client may request a service:

The client must provide all information relating to the requested service. The client is solely responsible for this information, including the following essential elements: date of service, pick-up location, drop-off location, pick-up time, number of passengers (adult/child), number of bags, nature of the service (airport shuttle, private or shared; other trip).

2.3. Determination of the price by Michel BERNARD Services

RMB TRANSPORTS sets the price of the service based on the information provided by the client. The price is inclusive of all taxes. It is firm and final, except in the cases provided under § 5 below.

2.4. Acceptance and payment of the price

If the client accepts the price, they validate their service request and pay the price. Payment is made in cash or by credit card. For other payment methods accepted by RMB TRANSPORTS, invoices must be paid at the company’s registered office by the due date.
Otherwise, RMB TRANSPORTS may charge interest, late-payment penalties, and damages. In accordance with Article L441-10 of the French Commercial Code, any late payment by a professional client will automatically incur late-payment penalties equal to three times the legal interest rate, plus a fixed €40 recovery fee.
RMB TRANSPORTS ensures the confidentiality of all personal data provided by the client.

2.5. Issuance of a booking confirmation by RMB TRANSPORTS

After the client confirms the service request and pays the price, RMB TRANSPORTS sends a booking confirmation by email or on paper, summarizing the details of the service.
The prior reservation must be demonstrable, in case of inspection, by means of a booking confirmation (paper or electronic), containing:
– the company name and contact details,
– the operating licence number,
– the client’s name and phone number,
– the date and time the reservation was made,
– the date, time, and pick-up location requested by the client.

The client is responsible for checking the information on the booking confirmation.
If RMB TRANSPORTS is unable to send the confirmation by email, the reservation is presumed to match the client’s request.

2.6. Special case of shared airport shuttles

For shared airport shuttles (services using a vehicle with multiple clients), the reservation only becomes final two business days after issuance of the booking confirmation, during which RMB TRANSPORTS may cancel it.
Additionally, within 24 hours prior to the scheduled pick-up time, RMB TRANSPORTS may adjust the pick-up time by up to ± one hour for operational reasons.
RMB TRANSPORTS will immediately inform the client of any such changes.


3. MODIFICATION OF THE RESERVATION

Except in the case referred to in § 2.6, any modification of one or more essential elements of the reservation results in its cancellation. RMB TRANSPORTS will make its best efforts to meet the client’s request for modification.


4. CANCELLATION & REFUND

4.1. Cancellation by the client before the pick-up time stated on the booking confirmation

For airport shuttles:
– 100% refund if cancelled more than 48 hours before pick-up
– 0% refund otherwise

For other trips:
– 100% refund if cancelled more than 24 hours before pick-up
– 50% refund if cancelled more than 6 hours before pick-up
– 0% refund otherwise

4.2. Cancellation after the scheduled pick-up time

No refund will be issued.
The service is deemed cancelled by the client if they fail to inform RMB TRANSPORTS of their delay:
– within 30 minutes for airport shuttles
– within 10 minutes for all other services.

4.3. Immediate cancellation

If the booking is cancelled within 5 minutes after RMB TRANSPORTS sends the booking confirmation, the service will be refunded at 100%.

4.4. No right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, passenger transport services scheduled for a specific date or period are not subject to the statutory 14-day withdrawal period.
Thus, consumer clients have no right of withdrawal; only the above cancellation terms apply.


5. PRICE INCREASE

Any delay by passenger(s) beyond the scheduled pick-up time results in a surcharge:
– 10 to 30 minutes: €10
– 30 minutes to 1 hour: €20
– Each additional 30 minutes: €10
These surcharges must be paid no later than at the time of boarding.


6. OBLIGATIONS & LIABILITY OF RMB TRANSPORTS

6.1. RMB TRANSPORTS undertakes to provide or arrange the service in accordance with the booking confirmation and applicable laws.

6.2. RMB TRANSPORTS is insured by a reputable insurance company covering risks related to its activity.

In case of subcontracting, RMB TRANSPORTS ensures the subcontractor meets the same requirements.
Professional and vehicle insurance provider: MAAF, contract no. 206188911.

6.3. RMB TRANSPORTS’ liability can only be engaged if the client proves a fault on its part and a causal link with the alleged damage.

RMB TRANSPORTS cannot be held liable in cases of force majeure (external, irresistible, and unforeseeable event) such as weather disruptions, demonstrations, accidents, roadworks, breakdowns, telecommunications failures, labour or equipment shortages.


7. OBLIGATIONS & LIABILITY OF THE CLIENT AND/OR PASSENGER

The client agrees, for themselves and any passengers concerned, to behave responsibly, particularly by respecting the driver, the vehicle, and the following rules:
– comply with the Highway Code (seat belts, child seats, boosters, etc.)
– no smoking; no transport of dangerous or prohibited materials.

Failure to comply is the sole responsibility of the client and passengers, and RMB TRANSPORTS may refuse or terminate the service.

Passengers are solely responsible for their belongings. RMB TRANSPORTS cannot be held liable in case of lost items left in the vehicle.


8. APPLICABLE LAW & JURISDICTION

These General Terms and the service contract are governed by French law.
Any dispute will be submitted to the competent French courts.

For professional clients: exclusive jurisdiction of the Arras Commercial Court.
For consumer clients: jurisdiction determined by applicable consumer protection laws.


9. CONSUMER MEDIATION

In accordance with Articles L611-1 et seq. of the Consumer Code, consumer clients may use a free consumer mediation service.
After submitting a written complaint to RMB TRANSPORTS without satisfactory resolution, the client may refer the matter to:

10. PERSONAL DATA PROTECTION

RMB TRANSPORTS, as data controller, collects and processes personal data for reservation management and execution of the transport service.
The legal basis for processing is contract performance.

Data are kept for the time necessary to complete the service and thereafter per legal retention periods.
They may be shared with partners or subcontractors involved in service execution.

Clients have the right to access, rectify, delete, restrict processing, object to processing, and obtain portability of their data.
